New Jersey cop sentenced to 5 years in prison for assaulting unarmed man, Former Newark,New Jersey police officer Hugo Fierro, 46, was sentenced to 5 years in prison on April 29. He was found guilty of third-degree aggravated assault and second-degree official misconduct, a charge which carries a 5 year mandatory minimum sentence.

The night of the assault was May 8, 2011. Fierro was celebrating his anniversary with his wife. The off-duty officer went to the aid of an unknown stranger who was on the sidewalk, and then according to nj.com Fierro was approached by another man who Fierro then, unprovoked, assaulted by repeatedly beating the man's face with his service weapon.

Fierro chose not to report the fight, but was later caught in his own web when the man he assaulted, unbeknownst, came to the police station to report his recently acquired beating. Then the walls began to close in on Fierro. Security footage was discovered which showed the assault. The case was cut and dry. Fierro says he simply lost control and his 'police instincts' took over. He was convicted in February.

This story did not have to end with Fierro in prison. He was given a chance to walk away and he chose not to take it.

Originally a deal was offered that involved no time in jail, a $250 fine, and Fierro would lose his job. He chose to go to trial knowing full well the consequences of being found guilty.

The now former cop and convicted felon woefully miscalculated and will spend the next 5 years of his life behind bars.
